The legislator has grouped the “obligated parties” under the term “manufacturer”. A manufacturer within the meaning of the WEEE Regulation is therefore anyone who produces electrical and electronic equipment:

  • manufactures and sells under its brand name (manufacturer).
  • resells under its brand name – unless the manufacturer’s brand name is affixed to the device in accordance with a) (dealer, distributor, marketer).
  • imports goods into Austria on a commercial basis (importer).
  • exports commercially for supply to final consumers (exporter).

All those obliged to do so must ensure that the electrical equipment they put into circulation is taken back and treated or recycled in accordance with the regulations.

A device is an electrical or electronic device if, for its proper operation:

  • electric current or electromagnetic fields is needed and
  • for operation with max. 1000 volts alternating voltage or 1500 volts direct voltage is designed and
  • falls under the equipment categories listed in Annex 1 of the WEEE Ordinance and
  • is not part of another device type.

Electrical and electronic equipment that qualifies as waste under AWG 2002, including all components, subassemblies and consumables that are part of the product at the time of discard.

  • electrical and electronic equipment intended for private households,
  • Electrical and electronic equipment that is comparable to WEEE from private households due to its type and quantity or with regard to its possible accumulation (dual use).
  • ATTENTION: All other devices according to the WEEE Ordinance are those for “commercial purposes”.

The following devices are affected by the WEEE Regulation:

  • Major household appliances
  • Small household appliances
  • IT and telecommunication equipment
  • Consumer electronics devices
  • Lighting fixture
  • Electrical and electronic tools
  • Toys and sports and leisure equipment
  • Medical devices
  • Monitoring and control instruments
  • Automatic output devices

The following 5 types of accessories can be identified, which are placed on the market with the electrical or electronic device when it is first fitted (without subsequent purchases):

  • Packaging: No, it is not part of the mass of the device.
  • Attached documents (user manuals, warranty statements, etc.): No, not part of the device.
  • Batteries: Yes, they must be weighed.
  • Accessories with electrical or electronic components: Yes, must be weighed.
  • Accessories without electrical or electronic components: Yes, must be included in the weighing if – the accessory is required to fulfil the intended basic technical function and – the accessory can be physically connected to the device.

    Collection and recycling of waste electrical equipment made easy – with Interzero Austria

    Transfer your take-back and recovery obligations under the Waste Electrical and Electronic Equipment Ordinance in Austria to Interzero Austria and thus benefit from our many years of experience.

    Anyone who places electrical equipment on the market in Austria or imports it into Austria for the purpose of their own activities (distributor) is also responsible for ensuring that the old electrical equipment is collected, recycled or treated in Austria. This is what the legislator has prescribed in the Ordinance on Waste Electrical and Electronic Equipment (EAG-VO). Accordingly, a producer within the meaning of the WEEE Ordinance is anyone who produces electrical or electronic equipment: a) manufactures and sells under its brand name (manufacturer) b) resells under its brand name – unless the manufacturer’s brand name is used in accordance with a) is affixed to the device (dealer, distributor, marketer) c) imports into Austria on a commercial basis (importer) d) exports for commercial purposes for sale to end users (exporter) All obligated parties must ensure the return and treatment or recycling of the electrical equipment they put into circulation (large appliances, small electrical appliances, refrigerators and freezers, screen and picture tube devices, gas discharge lamps, dual-use devices) in accordance with the regulations.
